Deferred Prosecution As An Alternative Mechanism To Criminal Proceedings For Legal Persons Under The Provisions Of Law 25/14

Authors : Sedrati Wafa .

Abstract

abstract The deferred prosecution system is one of the most significant provisions introduced by the new Code of Criminal Procedure No. 25-14, which forms part of the restorative justice approach that the Algerian legislature has begun to adopt in line with comparable legislation, given the results it has achieved in comparison with traditional justice. Under this system, the prosecution of legal persons may be subject deferral in respect of certain specified misdemeanours of an economic or financial nature, provided that the funds, property and proceeds disposed of or transferred outside the national territory—or their equivalent value—are returned, and all sums due to the public treasury are paid in full. In this study, we shall attempt to shed light on the provisions of deferred prosecution system as a new measure introduced by Law 25/14, its procedures and the consequences thereof.
