سلطان العرف وتأثيره في تنزيل النصوص الشرعية دراسة نظرية تطبيقية

الملخص
تؤصّل هذه الدراسة لبيان حاكمية العرف وسلطانه في تنزيل الأحكام الشرعية، حيث تمثلت إشكاليتها في: إلى أي مدى يُعتبَر العُرف سلطانًا مؤثرًا في تنزيل الأحكام الشرعية؟ وما هي ضوابط اعتباره؟ وقد هدفت إلى بيان مفهوم العرف وحجيته وأقسامه وأدلته الشرعية التي يستند إليها، وضوابطه الشرعية، وبيان المجالات الفقهية التي يتأثر فيها الحكم الشرعي بالعُرف عند تنزيل الأحكام عليها. وكما الضوء على أحد أهم أدوات الاجتهاد، ألا وهو العُرف ببيان حدوده في ضوء نصوص الشريعة وقواعدها الكلية. وقد اعتمدت في معالجة هذا الموضوع على المنهج الاستقرائي، والتحليلي، فتعرضت لبيان مفهوم العرف لغة واصطلاحا وأنواعه وشروط اعتباره، وبيّنت حجيته في الشريعة الإسلامية، ثم تطرقت لأهميته ومنزلته، وبيان أساس القوة الملزمة فيه، وفي الأخير نوهّت بسلطان العُرف وقوته في تفسير النصوص وتنزيله على الأحكام الشرعية مع ذكر نماذج من تأثيره في التنزيل الفقهي. وقد خلصت إلى أن الشريعة اعتبرت العرف في كثير من الأحكام العملية وبنتها عليه، وجعلت له منزلة في التنزيل. الكلمات المفتاحية: قوة العرف، الأحكام الشرعية، التنزيل، التخصيص، التفسير. This study establishes the authority and influence of custom in applying Islamic legal rulings. Its central question is: to what extent is custom considered an influential authority in applying Islamic legal rulings? And what are the criteria for its validity? The study aims to clarify the concept of custom, its legal authority, its categories, the legal evidence upon which it is based, and its legal criteria. It also identifies the areas of Islamic jurisprudence where custom influences the application of legal rulings. Furthermore, it sheds light on one of the most important tools of ijtihad (independent reasoning), namely custom, by clarifying its boundaries in light of Islamic legal texts and general principles. In addressing this topic, the study employs an inductive and analytical approach. It begins by defining the concept of custom linguistically and technically, exploring its types and the conditions for its validity. It then clarifies its legal authority in Islamic law, its importance and status, and the basis of its binding force. Finally, it highlights the authority and power of custom in interpreting texts and applying them to Islamic legal rulings, providing examples of its influence in legal application. It was concluded that Islamic law considered custom in many practical rulings and based them upon it, giving it a prominent place in the revelation.
