الملخص
الملخص: حظي حق التقاضي باهتمام كبير على المستويين العالمي والإقليمي في المواثيق الدولية والإقليمية حيث انطوت الكثير من الاتفاقيات على هذا الحق وعززت حمايته بمنع الاعتداء عليه، ويعتبر الحق في التقاضي من الالتزامات الرئيسة التي تعهدت الدول المتعاقدة بالوفاء بها ووفرت الضمانات الكافية لتيسير الوصول إلى المحاكم وسهولة الإجراءات وسرعتها للحصول على محاكمة عادلة تحفظ حقوق جميع الأشخاص وخاصة اللاجئين، فتوفير الضمانات الكافية يؤدي إلى حماية حق الإنسان في اللجوء إلى القضاء الذي يعتبر حقاً لا غنى للاجئ عنه والمحكمة الاوربية لحقوق الإنسان نموذج في مجالها، ووهي من بين أهم المحاكم الإقليمية ذات الصيت بفضل الضمانات التي تقدمها للاجئ عند التقاضي على حقه متمسكا بالحصول على هذه الصفة والحيلولة دون إعادته إلى بلده الأصلي. Abstract: The right of access to justice has received considerable attention at both the international and regional levels through international and regional instruments. Numerous conventions have enshrined this right and strengthened its protection by prohibiting any infringement upon it. The right to litigation is regarded as one of the principal obligations undertaken by contracting states, which have committed themselves to fulfilling it by providing adequate guarantees to facilitate access to courts, simplify procedures, and ensure their promptness in order to secure a fair trial that safeguards the rights of all individuals, particularly refugees. The provision of sufficient guarantees contributes to the protection of the human right to seek judicial recourse, which constitutes an indispensable human right. The European Court of Human Rights, alongside national courts, is considered one of the most prominent regional judicial bodies with a strong reputation in the field of refugee protection, ensuring their right of access to justice and preventing their return to their countries of origin.
