The study of the problem of non-enforcement of administrative judicial rulings and decisions contested to appeal is of great importance, as it reveals the tension that exists between, on the one hand, guaranteeing the litigant's right to appeal and, on the other hand, the need to enforce rulings and decisions issued by administrative judicial authorities once they have become final. While the enforcement of judgments and decisions issued in favor of the public administration does not raise any practical problems, the enforcement of judgments issued against it reveals a significant imbalance in the relationship between the administration and the litigant, as a result of the privileges and authority enjoyed by the administration. Addressing this issue is therefore essential for strengthening the protection of rights and freedoms and enhancing trust in the administrative judiciary.
Non-enforcement, appeal, Administrative courts of appeal, administrative judgments and decisions, public administration, compulsory enforcement.
