The Optional Clause Of The African Court On Human And Peoples’ Rights: A Step Toward A Better Future

Abstract
Human rights in Africa are growingly benefiting from wider protection through the establishment of monitoring mechanisms set to ensure the effective implementation of the provisions of the African Charter on Human and Peoples’ Rights. These mechanisms are expressed mainly in the African Commission and the African Court on Human and Peoples’ Rights. The Court, provided with a distinctive optional jurisdiction, allows individuals and non-governmental organizations with observer status before the African Commission to bring cases directly before it. Despite the obstacles and challenges that the Court continues to struggle with in conducting its monitoring functions, it however represents an authentic achievement for the African continent in the field of human rights supervision that requires enhanced support and reinforcement. ملخص: أصبحت حقوق الإنسان في القارة الإفريقية تحظى بحماية أوسع من خلال وضع آليات الرقابة على تطبيق ما جاء في الميثاق الإفريقي لحقوق الإنسان والشعوب. وهي آليات تتمثل أساسا في اللجنة والمحكمة الإفريقيتين لحقوق الإنسان والشعوب التي تتمتع باختصاص اختياري خاص، مع حق اللجوء أمامها لكل من الأفراد والمنظمات غير الحكومية التي تتمتع بصفة مراقب أمام اللجنة الإفريقية لحقوق الإنسان والشعوب. رغم العراقيل والصعوبات التي تواجهها المحكمة في أداء وضيفتها الرقابية إلا أنها تبقى مكسبا للقارة الإفريقية في مجال الرقابة على حقوق الإنسان، يحتاج إلى مزيد من الدعم. Résumé: Les droits de l’Homme en Afrique bénéficient d’une protection de plus en plus étendue grâce à la mise en place de mécanismes de contrôle destinés à assurer l’application effective des dispositions de la Charte africaine des droits de l’homme et des peuples. Ces mécanismes se traduisent principalement par l’existence de la Commission africaine et de la Cour africaine des droits de l’homme et des peuples. Dotée d’une compétence facultative spécifique, la Cour permet aux individus ainsi qu’aux organisations non gouvernementales disposant du statut d’observateur auprès de la Commission africaine de saisir directement la juridiction. Malgré les obstacles et les défis auxquels la Cour demeure confrontée dans l’exercice de ses fonctions de contrôle, elle n’en constitue pas moins une avancée authentique pour le continent africain dans le domaine de la protection des droits de l’homme, appelant un soutien accru et un renforcement continu.
