الإطار القانوني للإستيلاء المؤقت في التشريع الجزائري ( دراسة تحليلية نقدية)

الملخص
تسعى الإدارة العامة في إطار ممارستها لامتيازات السلطة العامة و لضمان تحقيق المصلحة العامة في الظروف الإستثنائية إلى جملة من الآليات خولت لها بموجب القانون، ومن ضمنها الإستيلاء المؤقت الذي تهدف من خلاله إلى ضمان إستمرارية المرفق العمومي و عدم تعطله رغم مساس هذا الإجراء بالملكية الخاصة و بحرية تقديم خدمات معينة. ABSTRACT: In exercising its prerogatives of public authority and in pursuit of safeguarding the public interest under exceptional circumstances, the public administration may resort to a number of statutory mechanisms, among which temporary requisition constitutes a crucial tool. This measure enables the administration to secure the continuity of essential public services without necessarily obtaining the consent of the concerned party, notwithstanding the fact that such an action entails an encroachment to upon private property and the freedom to provide certain services.
