ملخص: من أجل ضمان استغلال فعال للأراضي الفلاحية وفرت الدولة الجزائرية آليات قانونية صارمة لتنظيم و توجيه هذا القطاع، ويجسد ذلك الديوان الوطني للأراضي الفلاحية كهيئة عمومية مستقلة، مكلفة بتنفيذ سياستها الفلاحية، ومع ذلك تبقى الاستقلالية المقررة لهذه الهيئة شبه شكلية بسبب إخضاعها للوصاية المباشرة لوزارة الفلاحة و هيمنةالسلطة الإدارية المركزية على اتخاذ القرارات المتعلقة بنشاطها سواء من الناحية الوظيفيةأو المالية، هذاالوضعيؤدي إلى تقليص فعاليةالمهام المتعددة للهيئة رغم توسع نطاقها نظريا و ذلك في ظل نقص الوسائل الضرورية لأدائها. RESUME Afin d'assurer une exploitation efficace des terres agricoles, l'État algérien a prévu des mécanismes juridiques stricts pour réglementer et diriger ce secteur, et cela est incarné par l'Office national des terres agricoles en tant qu'organisme public indépendant, chargé de mettre en œuvre sa politique agricole. , l'indépendance attribuée à cet organisme reste quasi formelle du fait qu'elle est soumise à la tutelle directe du ministère de l'Agriculture. La domination de l'autorité administrative centrale dans la prise de décisions liées à ses activités, que ce soit sur le plan fonctionnel ou financier, cette situation conduit à la réduire. l'efficacité des multiples tâches de l'Autorité malgré l'élargissement de son champ d'action Abstract:In order to ensure the effective exploitation of agricultural lands, the Algerian state has provided strict legal mechanisms to organize and direct this sector. This is embodied in the National Office of Agricultural Lands as an independent public body, charged with implementing its agricultural policy. However, the independence granted to this body remains almost formal due to its being subject to the direct supervision of the Ministry of Agriculture and the dominance of the central administrative authority over decision-making related to its activity, whether from a functional or financial perspective. This situation leads to a reduction in the effectiveness of the body’s multiple tasks, despite the theoretical expansion of its scope, in light of the lack of the necessary means to perform it.
