Abstract This paper examines the principle of precaution (iḥtiyāṭ) in the Mālikī school as an expression of moderation (wasatiyyah) in both jurisprudential and theoretical (uṣūlī) contexts. It highlights that precaution seeks to ensure certainty in fulfilling religious obligations, yet may cause hardship if applied excessively. The study focuses on two key legal maxims: “What is necessary to complete an obligation is itself obligatory” and “When the lawful and unlawful are combined, the unlawful prevails.” Using a deductive and analytical method, the paper explains how the Mālikī approach balances between caution and ease. It demonstrates that precaution is not meant to lead to rigidity, but to safeguard religious practice. The research shows that both maxims reflect a unified objective of achieving legal certainty.
