إسهام القاضي الدستوري في حماية مبدأ الأمن القانوني

الملخص
تهدف هذه الدراسة إلى تحليل دور القاضي الدستوري في حماية مبدأ الأمن القانوني في النظام القانوني الجزائري من خلال الرقابة الدستورية على التشريعات، وفحص كيفية تكريس هذا المبدأ في الدستور الجزائري لعام 2020. وقد أظهرت الدراسة أن تكريس مبدأ الأمن القانوني في التعديل الدستوري لعام 2020 يمثل خطوة هامة نحو ضمان استقرار النظام القانوني وحماية الحقوق والحريات. كما أكدت على قدرة المحكمة الدستورية في تعزيز هذا المبدأ عبر آليات مختلفة خاصة آلية التحفظات التفسيرية وإلغاء النصوص المخالفة للدستور. ومع ذلك، تثير قاعدة الأثر الفوري لقرار عدم الدستورية إشكاليات تتعلق بالموازنة بين مبدأ الأمن القانوني والمشروعية، حيث يبرز التحدي في الحفاظ على استقرار الحقوق المكتسبة وسط التغييرات المفاجئة في التشريعات. This study aims to analyze the role of the constitutional judge in protecting the principle of legal certainty within the Algerian legal system through constitutional review of legislation. It also seeks to examine how this principle is enshrined in the Algerian Constitution of 2020 and the mechanisms employed by the Constitutional Court to ensure the stability of rights and freedoms. The study showed that enshrining the principle of legal certainty in the 2020 constitutional amendment is an important step toward ensuring the stability of the legal system and the protection of rights and freedoms. It also confirmed the Constitutional Court's ability to strengthen this principle through mechanisms such as interpretive reservations and the annulment of unconstitutional provisions. However, the principle of immediate effect of the unconstitutionality ruling raises issues related to balancing legal certainty and legitimacy, where the challenge lies in maintaining the stability of acquired rights amid sudden changes in legislation.
