الملخص

يتناول هذا البحث موضوع الدعاوى الكيدية بين الزوجين، بوصفه من القضايا الأسرية المعاصرة التي تعد من الظواهر السلبية، لما فيها من استغلال لحق التقاضي للإضرار بالطرف الآخر، مما يخل بمقاصد الزواج ويهدد كيان الأسرة. وتبرز أهمية هذا البحث في كونه يسعى إلى تسليط الضوء على هذه الظاهرة من زاوية فقهية وقانونية، وذلك ببيان حكمها الشرعي وعقوبتها في الفقه الإسلامي، مع ربط ذلك بما تقرره القوانين في دولة الإمارات العربية المتحدة. ويهدف البحث إلى تأصيل مفهوم الدعاوى الكيدية، وتحليل أسبابها المتعلقة بالزوجين، وبيان الموقف الفقهي والقانوني منها، بالإضافة إلى بيان العقوبات المقررة تجاهها في الفقه والقانون الإماراتي، في محاولة للإسهام في الحد من هذه الظاهرة، وتحقيق الاستقرار الأسري. This study addresses the issue of malicious litigation between spouses—an increasingly prevalent phenomenon within contemporary family disputes. Such cases represent a misuse of the right to litigation with the intention of harming the other party, ultimately undermining the objectives of marriage and threatening the stability of the family unit. The significance of this research lies in its attempt to examine the phenomenon from both an Islamic jurisprudential and legal perspective. It outlines the Islamic legal ruling and prescribed penalties for malicious litigation, and relates these to the legal framework in the United Arab Emirates. The research aims to establish a jurisprudential foundation for the concept of malicious litigation, analyze its underlying causes related to marital conflict, and assess the legal and juristic positions regarding it. It also highlights the penalties prescribed under both Islamic law and UAE legislation, with the goal of curbing this practice and promoting family stability.
