منهج البحث العلمي في فقه النوازل

الملخص
ملخص: خلود الشريعة يستلزم صلاحها لكل زمان ومكان، وذلك يظهر بمواكبتها لتغيرات العصر ومتطلبات الحياة، وما من نازلة بالمسلمين إلا وفي الشريعة بيان لحكم الله فيها، إلا أن نوازل عصرنا امتازت بكونها مركبة ومعقدة، نتيجة الانفتاح الحضاري الواسع في شتى الميادين، وقد أدّى هذا بالعلماء إلى سلوك منهج مختلف عن السابق في الوصول إلى الحكم الشرعي، تكون خطواته محددة ومرتبة، ضمن قواعد وضوابط دقيقة، حتى صار يعرف هذا الاجتهاد عند العلماء بمنهج البحث في فقه النوازل، يجمع بين علماء الشرع من جهة، والخبراء في العلوم المختلفة من جهة أخرى، فتُجمع كل المعلومات المتعلقة بالنازلة وتُربط بأصولها الفقهية، لتأخذ الحكم المناسب لها. Abstract: The immortality of the Sharia requires its validity for all times and places, and this is evident in its keeping pace with the changes of the era and the requirements of life. There is no calamity that befalls Muslims without the Sharia stating God's ruling on it. However, the calamities of our era have been distinguished by being complex and intricate, as a result of the broad civilizational openness in various fields. This has led scholars to adopt a different approach than before in reaching the Sharia ruling, the steps of which are specific and arranged, within precise rules and controls Until this ijtihad became known among scholars as the research method in the jurisprudence of new issues, bringing together Sharia scholars on the one hand, and experts in various sciences on the other hand, so that all information related to the new issue is collected and linked to its jurisprudential principles, in order to take the appropriate ruling for it.
