الخطاب العامي في تاريخ الغرب الإسلامي وأثره على الفتوى من خلال كتاب المعيار المعرب للإمام الونشريسي

الملخص
يتناول هذا المقال أثرا تاريخيا من آثار الحضارة الإسلامية في غرب رقعتها الجغرافية، في المغرب العربي والأندلس، وهو الخطاب العامي والتراث اللفظي المتداول فيها، وكان ذلك من خلال موسوعة علمية في الفتاوى الشرعية، وهي كتاب "المعيار المعرب" للإمام الونشريسي، فتم استخراج نماذج من الكلمات والسياقات العامية من هذه الموسوعة العلمية، وبحكم أن كتاب "المعيار" في الفقه والفتوى؛ فقد جاءت محاولة الربط بين الجانبين في الكتاب، وذلك بإبراز أثر هذا الخطاب العامي، والاستعمال العرفي؛ في فتاوى المفتين، سواء من جهة الحاجة إلى إدراك مراميه، حتى يفهم الاستفتاء ويصح الإفتاء، ومن جهة أنه مظهر ثقافي لا مناص من مراعاته وفهمه، بل وحتى استخدامه. This article deals with a historical heritage of Islamic civilization in its western area - in the Maghreb and al-Andalus, represented by the colloquial discourse and the linguistic heritage commonly used there. This was examined through an academic encyclopedia of Islamic Fatwas, namely the book "Al-Mi'yar al Mu'rib" (the Clarified Criterion) by Imam al Wansharisi. Samples of colloquial words and contexts from this work were used, and since it deals with jurisprudence (Fiqh) and Fatwas, an attempt has been made to establish a connection between these two aspects by highlighting the impact of colloquial discourse and customary usage in the Muftis' Fatwas, both in terms of the need to grasp its intended meaning- so that seeking and issuing Fatwas may be properly understood, and in terms of its role as a cultural phenomenon that must inevitably be recognized, understood and even used.
