The evolution of cyberspace has redefined freedom, producing new forms of digital freedoms shaped by legal regulation and algorithmic governance. This paper investigates the tension between these forces, arguing that the liberal concept of non-interference fails to capture the realities of algorithmic domination. Adopting a qualitative comparative approach, the study examines European and Algerian regulatory frameworks. Findings reveal a structural gap between rapid technological innovation and slower legal adaptation, alongside a growing shift of power toward digital platforms. The paper proposes an “Algorithmic Dialectical Model” to conceptualize digital freedom as a dynamic interaction between legal, technological, and social dimensions.
