الإقرار النبوي وأثره في التقعيد الأصولي

الملخص
تتمحور فكرة هذا المقال في إظهار جانب من عناية الأصوليين بنوع من أنواع السنة النبوية المطهّرة التي هي المصدر الثاني من المصادر الأصلية للتشريع الإسلامي، وعرض أوجه هذه العناية والخدمة في جانبها التأصيلي مصحوبة بالأمثلة التوضيحية التطبيقية؛ وبيان كيفية استثمارهم لها، واستدلالهم بها على تقعيد أصول فقهية في محاور متنوعة من علم أصول الفقه ومباحثه التي لا تتعلّق بالأدلة الأصلية للفقه الإسلامي المتفق على حجّيتها، لتتجلى بذلك أهمية هذا النوع من السنة النبوية الشريفة، ومدى أثره على الكليات الشرعية، وتظهر عناية الأصوليين به، كما يظهر تنوّع مآخذهم وأدلتهم التي استوعبت المنقول والمعقول معا في تشييد صرح علم أصول الفقه، وتثبيت بنيانه وتقرير قواعده وكلياته. كلمات مفتاحية: أصول الفقه –السنّة -الإقرار النبوي – الأدلة الشرعية –الاجتهاد. Abstract: The idea of this article is embodied in highlighting an aspect of the attention paid by scholars of Usul al-Fiqh (Principles of Islamic Jurisprudence) to a specific type of prophetic Sunnah—the linguistic Sunnah—which is the second original source of Islamic legislation. The article presents the various dimensions of this attention and service, with detailed examples, illustrating how scholars utilized and inferred from it to establish other jurisprudential principles in various areas and discussions of Usul al-Fiqh not directly related to the primary evidences of Islamic law and their authenticity. This demonstrates the significance of this type of noble prophetic Sunnah and its impact on the overarching legal principles. It also showcases the deep concern shown by scholars of Usul, as well as the diversity of their approaches and evidence—encompassing both transmitted texts and rational reasoning—in constructing and solidifying the structure of Usul al-Fiqh
