Summary: The critical studies that sought to refine concepts of democracy and the effective participation of citizens in achieving a robust mechanism to guarantee their fundamental rights and freedoms, as enshrined in the social contract between them and the governing authority, have highlighted the concept of participatory democracy. This concept is undeniably a political approach that promotes the direct participation of citizens and civil society in public policy-making. It is also a modern mechanism for strengthening human rights through the activation of public oversight, where the judiciary plays a crucial role in protecting and constitutionally and legally enshrining these rights. Undoubtedly, judges have personal biases, given human nature itself; they are products of their environment. However, they are obligated to protect fundamental rights and freedoms by adjudicating disputes between parties according to reliable legal standards. This necessitates their complete independence from the parties whose disputes they are considering, which is perfectly logical. Consequently, demanding the independence of judges, especially from the executive authority, is an absolute necessity. But considering the connection between the preparation of laws, which are purely legislative tasks in which the individual participates according to the participatory democratic view, and the implementation of the law through mechanisms related to the regulatory aspect, the tasks assigned to the executive and judicial bodies, the political process emerges, in which proponents of the idea of the independence of the judiciary evade political tasks. The protection of basic rights and freedoms and the oversight that must be exercised by judicial bodies over this area highlights the interaction that occurs in this equation in service of the popular authority established in the constitutional documents.
