The best interests of the child are a fundamental principle of family law, representing a legal standard guiding judges when adjudicating various family disputes in which a child is a party or affected by the outcome, such as cases concerning custody, alimony, visitation rights, and establishing parentage. This principle aims to guarantee the child's protection and ensure their physical, psychological, and social well-being, recognizing them as the most vulnerable group in family disputes. This principle has been enshrined in numerous national laws and international conventions, most notably the Convention on the Rights of the Child adopted by the United Nations in 1989, which emphasizes the necessity of prioritizing the child's best interests in all decisions concerning them. Within the context of family disputes, judges possess broad discretionary power in determining what constitutes the best interests of the child, given the complexity of family relationships and the varying social and psychological circumstances of each case. The judge does not merely apply legal texts but also relies on an assessment of the facts and specific circumstances of the case, utilizing social and psychological expert reports and the legal means available to reveal the truth. However, this discretionary power can sometimes lead to discrepancies in judicial rulings due to differing assessments of the facts by judges or variations in judicial interpretations, raising the challenge of balancing judicial flexibility with ensuring legal stability
