Recent economic and technological developments have revealed the shortcomings of the classic legal theory based on freedom of contract, as it is no longer capable of regulating complex market economy contracts. This prompted legislators to restrict this freedom to achieve balance and protect vulnerable parties, evidenced by special legislation such as competition and consumer protection laws. Although civil law remains the general law, new economic actors and the growing role of special laws have brought fundamental changes to contractual relationships. These developments highlight the need to understand the impact of special legislation on classic rules and analyze the legal system's effectiveness in achieving justice and economic stability amidst rapid changes.
