الرسمية في عقد الوقف طبقا للقانون رقم 25-06

الملخص
تتميز المعاملات الواردة على العقارات مهما كان نوعها بإجراءات خاصة لاسيما ما يتعلق منها بالطابع الرسمي، نظرا لأهمية الملكية العقارية للأفراد. والملكية الوقفية أحد أصناف الملكية العقارية، والتي نظمها المشرع الجزائري بأحكام قانونية خاصة نظرا للطابع الخاص الذي تتميز به عن غيرها من أصناف الملكية العقارية. ويعد القانون رقم 25-06 أحدث نص قانوني نظم الأوقاف في الجزائر، بعد القانون رقم 91-10 الذي استمر تطبيقه لما يزيد عن ربع قرن، وبما أن عقد الوقف من العقود ذات الطابع الخاص أوجب المشرع تحريرها في شكل رسمي على يد موثق أو ضابط عمومي، إضافة الى لزوم اتباع إجراءات الشهر العقاري والتسجيل؛ فالكتابة الرسمية اللازمة في عقود الوقف لازمة لانعقاده وإلا ترتب بطلان العقد في حال تخلفها، كما أن هذه الشكلية وسيلة لإثبات التصرف الوقفي. Any type of transactions is drawn up in any real estate is characterized by special procedures, especially those related to the formal nature, as real estate ownership for individuals is important. Endowment ownership is one of the types of real estate ownership, which is regulated by the Algerian legislator with special legal provisions, due to its special character that distinguishes it from other types of real estate ownership. Law No. 25-06 is the most recent legal text regulating endowments in Algeria, after Law No. 10-91, which continued to be applied for more than a quarter of a century. whereas the endowment contract is deemed one of the contracts of a special nature, the legislator ordered that it shall be drawn up in an official form at a Notary or a public officer, in addition to the necessity of following the procedures of real estate registration and recording. The official writing required in endowment contracts is necessary for its conclusion, otherwise the contract is null and void in the event of its absence. This formality is deemed as a means of proving the endowment transaction.
