The phenomenon of human shields is not new; however, its use has expanded in contemporary armed conflicts. This practice is most frequently observed in conflicts characterized by a lack of proportionality in power between the warring parties, which may compel one of the parties to resort to the use of human shields. Such shields may be employed either coercively or voluntarily. Armed conflicts often result in significant human losses, with civilians being among the most affected groups, in addition to other persons entitled to protection. This situation constitutes a direct violation of the fundamental principles governing armed conflicts, whether within the framework of international humanitarian law or under Islamic law (Sharia). In this study, we examine the jurisprudential and legal rules governing the use of human shields during armed conflicts, through a comparative analysis between international humanitarian law and Islamic jurisprudence.
