The Non-existent Administrative Act: Between Ex Officio Administrative Self-rectification And Judicial Oversight

Authors : Senoussaoui Somia .

Abstract

This article examines the notion of the non-existent administrative decision within a legal framework that foregrounds its specificity as a heightened configuration of illegality. In this context, it scrutinizes—through both administrative and judicial lenses—the mechanisms devised to rectify the legal situations engendered by this category of unlawful administrative conduct. Confronting the non-existent administrative decision necessitates a functional interpenetration of two principal mechanisms. The first is administrative self-correction ex officio, regarded as a manifestation of the administration’s adherence to the principle of legality and its competence to efface the effects of its unlawful acts on its own initiative. The second is judicial review, which assumes a decisive role in resisting such acts—whether through administrative summary proceedings (urgent relief) or within the framework of adjudication on the merits.
