العقد الاداري الإلكتروني : بين استمرارية المفهوم واختلاف وسيلة الابرام

الملخص
الملخص : لقد أدى الانتشار الواسع لاستخدام الإنترنت، وازدهار مجالات التجارة الإلكترونية والحكومة الإلكترونية، إلى ظهور عقود إلكترونية لا تختلف عن العقود التقليدية من حيث أركانها وأطرافها، بل هي ذاتها حيث تظهر خصوصيتها فقط في وسيلة ابرامها، ومن خلال اتساع نطاق عقود التجارة الإلكترونية التي تتميز بابرام العقود عن بعد دون الحاجة الى التقاء مادي للمتعاقدين في مجلس العقد، ودون الاعتماد على أي وثائق ورقية، هذا ما ساهم في تراجع الاعتماد على دعامة الورقية التقليدية لصالح دعامة الرقمية الحديثة، وبفعل صدور تشريعات تنظم المعاملات الإلكترونية والتوقيع الإلكتروني، عرفت العديد من الدول التحول إلى ما يعرف بالإدارة الإلكترونية، مما انعكس على نشاط الإدارة العامة، بفعل إدماج الوسائل الإلكترونية في مختلف مراحل ابرام العقد الاداري، سواء في مجال الاتصال الإداري أو تبادل المعلومات أو حتى في عملية التعاقد ذاتها، وبالتالي أصبحت تُبرم عقود ادارية الكترونية هي ذات العقود الادارية التقليدية غير أنها تختلف في وسيلة ابرامها فهي تتم عبر وسائط الكترونية . Abstract : The widespread use of the Internet, and the flourishing of e-commerce and e-government fields, has led to the emergence of electronic contracts that do not differ from traditional contracts in terms of their elements and parties, as they are essentially the same, with their distinctiveness appearing only in the method of their conclusion. With the expansion of the scope of e-commerce contracts, which are characterized by being concluded remotely without the need for the physical presence of the contracting parties in the contract session, and without relying on any paper documents, this has contributed to the decline of reliance on the traditional paper-based support in favor of modern digital support. Due to the issuance of legislation regulating electronic transactions and electronic signatures, many countries have experienced a shift toward what is known as e-administration, which has reflected on the activity of public administration through the integration of electronic means in various stages of concluding administrative contracts, whether in the field of administrative communication, information exchange, or even in the contracting process itself. Consequently, electronic administrative contracts are concluded, which are identical to traditional administrative contracts except that they differ in the method of conclusion, as they are carried out through electronic means .
