تحديات المحافظة على الأعراف بين التقاليد والحداثة: مقاربة شرعية فقهية

الملخص
يهدف هذا البحث إلى دراسة تحديات المحافظة على الأعراف بين التقاليد والحداثة من منظور شرعي فقهي مقاصدي. فقد بيّن البحث أنّ العرف يُعدّ من الأدلة التبعية المعتبرة في الشريعة الإسلامية متى انضبط بضوابط الشرع ومقاصده. كما أبرز أن الشريعة تعاملت مع الأعراف وفق منهج التهذيب، فأبقت على الأعراف النافعة وأبطلت الفاسدة منها. وقد تناول البحث بالتفصيل الإطار المفاهيمي والشرعي للعُرف، ثم رصد التحديات الفكرية والاجتماعية المعاصرة التي تهدد الأعراف في ظل الحداثة والعولمة، ليخلص في الأخير إلى مقاربة فقهية مقاصدية متوازنة تحقق التوفيق بين المحافظة على التقاليد الأصيلة والاستجابة لمتطلبات العصر. وتوصل البحث إلى أن الاعتماد على المقاصد الشرعية يمثّل السبيل الأمثل لتجديد الأعراف وضبطها، بما يعزز الأمن الفكري والاجتماعي ويحافظ على هوية الأمة وقيمها الأصيلة. This research aims to explore the challenges of preserving customs between tradition and modernity from a Sharīʿah-based and Maqāṣid-oriented jurisprudential perspective. The study demonstrates that custom (ʿurf) is considered a valid subsidiary source of Islamic law, provided it adheres to the principles and objectives of the Sharīʿah. It also shows that Islam has historically approached customs with a method of refinement, preserving beneficial practices while abolishing those that contradict divine guidance. The research first clarifies the conceptual and legal framework of ʿurf, then analyzes the intellectual and social challenges that threaten customs under modernity and globalization. Finally, it proposes a balanced jurisprudential vision grounded in Maqāṣid al-Sharīʿah to reconcile authentic traditions with the requirements of contemporary life. The study concludes that employing the maqāṣid-based approach is the most effective way to reform and regulate customs in a manner that strengthens intellectual and social security while safeguarding the identity and values of the Muslim community.
