تحديات العرف في الجانب الفكري والاجتماعي

الملخص
ينطلق الحديث عن العرف من مدخل تأصيل مصادر الشريعة الإسلامية، وبيان اتفاق العلماء على اعتماد المصادر الأصلية متمثلة في الكتاب والسنة والإجماع والقياس، ثم تليها المصادر التبعية، مثل الاستحسان وقول الصحابي وشرع من قبلنا، ومنها العرف، أو العادة. وتواجه العرف الحالي في المجتمعات المسلمة تحديات كبيرة، فكرية واجتماعية، منها ما يعود إلى واقع العرف ومدى فعاليته واستجابته لطموحات المجتمع، ومنها ما يعود لعوامل خارجية تتمثل في العولمة الفكرية، واكتساح أفكار التحرر لكل المجتمعات، وانفلات القيم والمرجعيات الدينية والاجتماعية، وهو ما يقتض ي جهودا مخلصة لتنقية الموجود وتأصيل الصحيح من الأعراف، وحمايتها من الدخيل غير الصالح لضمان استمرار دور العرف الصحيح في الحماية الفكرية وتأمين استقرار المجتمعات الإسلامية في ظل موج العولمة وطوفانها الكاسح للقارات. The discussion of custom (ʿurf) begins with the foundational study of the sources of Islamic law. Scholars unanimously agree on the primary sources: the Qur’an, the Sunnah, consensus (ijmāʿ), and analogical reasoning (qiyās). These are followed by the subsidiary sources, such as juristic preference (istiḥsān), the statements of the Companions, the laws of previous nations, and among them, ʿurf (custom) or ʿādah (hadit). The current customs in Muslim societies face major intellectual and social challenges. Some of these challenges stem from the state of customary practices themselves — their effectiveness and their ability to meet the aspirations of society — while others arise from external factors such as intellectual globalization, the spread of ideas of liberation across all societies, and the loosening of moral, religious, and social values and references. This situation calls for sincere efforts to refine existing customs, to preserve and strengthen the sound ones, and to protect them from harmful foreign influences, in order to ensure that sound custom continues to play its vital role in intellectual protection and in maintaining the stability of Muslim societies amid the overwhelming tide of globalization.
