Standards Of Compatibility In Marriage: Between Tradition And Contemporary Developments

Abstract

This study addresses the issue of spousal compatibility from a legal perspective, focusing on how it is regulated across various Arab legal systems, without delving into its treatment in Islamic jurisprudence. The significance of compatibility lies in its role in fostering harmony between spouses and ensuring the stability of the family relationship. Arab legislations differ in the extent to which they recognize criteria for compatibility. Some do not address it explicitly, referring to it only implicitly within the framework of contractual freedom or the guardian’s consent. The study aims to analyze these variations and explore their impact on the social reality. It also seeks to evaluate the effectiveness of these criteria in maintaining family stability and proposes a unified legal approach that both respects social particularities and responds to the demands of modern development.
