Brain Death And Its Impact On Inheritance Rulings

Abstract

One of the modern medical issues that has sparked widespread debate among scholars, jurists and doctors is brain death, with differing opinions on how to define it. Some consider it to be true death if all functions cease, including those of the brain stem, leading to the loss of the ability to breathe naturally and unresponsiveness to any medical attempts. Others consider it to be true death as soon as the brain ceases to function completely, without requiring the other organs to cease functioning.Based on this dispute, the implications of brain death have varied, especially in rulings related to inheritance. There has been a clear difference of opinion as to whether it is considered effective or judgemental death, which has been reflected in issues such as the distribution of the estate, the inheritance rights of a person who is considered brain dead, or the transfer of inheritance from them to others.
