مسؤولية متولي الرقابة في التشريع الجزائري بين النص و المأمول

الملخص
الملخص: تندرج مسؤولية متولي الرقابة وفق أحكام القانون المدني الجزائري ضمن المسؤولية عن فعل الغير، و التي أقرها المشرع كاستثناء عن القاعدة العامة للمسؤولية التقصيرية القائمة على أساس الخطأ الشخصي الواجب الإثبات، و هذا تماشيا مع الدور الإصلاحي لها؛و الذي يقوم على ضمان تعويض عادل لكل مضرور، إلا أن تأسيس المشرع لمسؤولية متولي الرقابة على أساس الخطأ المفترض القابل لإثبات العكس قد يؤدي إلى الحياد عن الهدف المرجو من إقرارها، ناهيك عن التفكير في مدى صحة القول بأنها مسؤولية عن فعل الغير، و هو الأمر الذي أصبح يستدعي ضرورة التخلي عن هذا الأساس،و التوجه نحو إقرار مسؤولية موضوعية لمتولي الرقابة تقوم بقوة القانون ولا يمكن نفيها إلا لسبب أجنبي أو خطأ المضرور؛ لاسيما أمام ما تتسم به الفئة المشمولة بالرقابة من خصوصية تستدعي التشديد من مسؤولية متولي الرقابة. Abstract: The liability of the person entrusted with supervision, according to the provisions of the Algerian Civil Code, is part of the system of liability for the acts of others. This type of liability has been established by the legislator as an exception to the general principles of tort liability, which is subject to the personal fault. This consistent with the remedial purpose of such liability, which is to provide fair compensation to any injured party. Nevertheless, the legislator’s reference of the supervisor’s liability on the basis of assumed fault, which is subject to rebutting evidence to the contrary, may result in a departure from the rationale for which it was created. Furthermore, there is room for questioning the validity of referring to it as liability for acts of others. This is where there is a need to depart from this rationale and proceed with the establishment of strict (objective) liability for the supervisor, which is provided by law and is only relieved in cases of foreign cause or victim’s fault. This is notably true in reference to the particular nature of the category that is subject to supervision, which requires a stricter approach with regard to liability for the supervising party.
