الاجتهاد الوسطي في المذهب المالكي من خلال منهج الإمام اللخمي في تقرير الأحكام وتنـزيلها

الملخص
يعتبر الإمام اللخمي شخصية علمية مميزة؛ وذلك نظرا لكونه أثار اختلافا بين علماء المذهب المالكي في تقويم مذهبه، لتباين الأنظار حول اختياراته الفقهية التي خرج فيها عما به الفتوى في المذهب. ومن هنا يكمن هدف هذا البحث في مدى الاستفادة من منهج الاجتهاد الوسطي في ضبط المستجدات والنوازل.ومما يقرر بلوغ الإمام اللخمي منزلة مرموقة، اعتماد الشيخ خليل لاختياراته في مختصره الفقهي. غير أنه عند تحقيق المناط يتضح أن الإمام اللخمي قد برز بتوطين أصول المذهب المالكي، يتجلى ذلك في مراعاة الاعتدال والوسطية في تقرير فتاواه، وهذا ما سيتبين من خلال ثنايا هذا المقال. Imām al-Lakhmī is regarded as a distinguished scholarly figure, as his juristic stance generated disagreement among Mālikī scholars regarding the evaluation of his legal school. This divergence stems from differing perspectives on his juristic choices, in which he departed from the dominant fatwā positions within the school. Accordingly, the aim of this study is to examine the extent to which a methodology of moderate ijtihād can be employed in regulating contemporary developments and unprecedented legal cases (nawāzil).Evidence of Imām al-Lakhmī’s attainment of a prominent scholarly rank is found in Shaykh Khalīl’s reliance on his juristic choices in his renowned legal compendium (al-Mukhtaṣar). However, upon closer contextual analysis (taḥqīq al-manāṭ), it becomes clear that Imām al-Lakhmī excelled in consolidating the foundational principles of the Mālikī school. This is manifested in his adherence to moderation and balance in issuing legal opinions, a feature that this article seeks to demonstrate throughout its discussion.
