Abstract Algeria has guaranteed freedom of belief since regaining its independence, up to the recent constitutional amendment in 2020, which replaced the term with the guarantee of freedom of worship in Article 51, sparking controversy among activists and human rights advocates. This drew attention from international organizations and even some countries, accusing Algeria of encroaching on a fundamental human right, namely the freedom to choose one’s religion and practice it. It’s worth noting that Algeria, as a Muslim country, explicitly states in Article 2 of its constitution that Islam, the foundation of rights and freedoms, ensures freedom of belief with all its guarantees, albeit with some restrictions similar to those imposed by international organizations and treaties legislating modern human rights, which are necessary to prevent chaos and widespread corruption. Freedom of belief is protected in Algeria, and the omission of the term from the constitution does not negate its assurance for non-Muslims under the legal conditions established by Law 06-03, a topic that will be discussed in this research paper.
