Abstract

Abstract : International commercial disputes are a significant result of economic globalization, raising legal challenges related to legal certainty and economic stability for contracting parties. This study analyzes the effectiveness of dispute resolution mechanisms in the cross-border commercial context, with particular emphasis on international commercial arbitration and modern electronic methods. It evaluates the role of national courts, especially regarding jurisdiction and enforcement of foreign judgments, and examines the effectiveness of arbitration under the 1958 New York Convention. The study also addresses alternative mechanisms such as conciliation, mediation, and online dispute resolution (ODR). The findings show that national courts face practical limitations, while international commercial arbitration remains relatively the most effective mechanism, despite concerns related to sovereignty and public policy. Modern mechanisms represent a promising direction that requires further international regulation
