This article examines the subject of e-commerce from the perspective of Islamic law and legal regulation. The primary aim of this academic paper is to clarify the concept of e-commerce contracts, to set out the evidence for their legitimacy from jurisprudential sources, and to define the legal and contractual conditions required by the contracting parties. The researcher concluded that the Sharia conditions required in traditional commerce, such as consent, disclosure of the price and the item sold, and the realisation of benefit, are the same as those that apply to e-commerce without any difference. The study also emphasised the permissibility of ‘contractual’ conditions set by the contracting parties, such as requiring payment by credit card, specifying a particular currency, or a specific shipping provider, provided that these do not contravene any legal text or lead to prohibited usury. The paper also concluded that the use of contemporary electronic means of payment, such as covered and prepaid cards, is permissible under Islamic law and contributes to safeguarding the rights of the parties and realising their interests in terms of a balance between benefit and returns.
