ضمانات استقلالية سلطة ضبط السمعي البصري في التشريع الجزائري

الملخص
يندرج انشاء سلطة ضبط السمعي البصري ضمن إطار التحولات والاصلاحات السياسية والدستورية التي شهدتها الجزائر سنة 2012، وفتح مجال السمعي الصري، وتتمتع هذه السلطة بالاستقلالية العضوية والوظيفية المعترف لها بها بموجب النصوص القانونية، من خلال تركيبتها العضوية ونظام العهدة والحصانة وحالات التنافي، وعدم تبعيتها لأي جهة عليا في تسيير شؤونها الإدارية والمالية ووضع نظامها الداخلي والمصادقة عليه. غير أن هذه الاستقلالية نسبية، لِاحتكار السلطة التنفيذية صلاحية تعيين أعضاء السلطة وخضوع هذه الأخيرة لرقابة وصائية، واعتمادها على موارد مالية مقيدة باسمها في الميزانية العامة للدولة، وتهدف هذه الدراسة إلى تقديم الضمانات القانونية لاستقلالية هذه السلطة، وتقديرها من خلال مطابقتها مع الواقع العملي. However, this independence is relative, for the monopoly of the executive authority the authority to appoint members of the Authority and the latter subject to a state control, and its dependence on financial resources restricted in its name in the state’s general budget, and this study aims to provide legal guarantees for the independence of this authority, and its appreciation through its conformity with the practical reality
