Abstract
ملخص: يسعى هذا البحث إلى تحديد المسؤولية القانونية للشركات الصناعية عن الأضرار البيئية بهدف ضبط التوازن بين تطور الصناعات والحفاظ على البيئة وسلامتها. حيث تلزم القوانين الشركات باتخاذ إجراءات وقائية تحد من التلوث البيئي وتحمي الموارد الطبيعية. ويتناول البحث هذه أنواع المسؤولية ومنها المسؤولية المدنية التي تفرض على الشركات لتعويض الأفراد والمجتمعات عن الأضرار الناجمة عن أنشطتها، والمسؤولية الجنائية التي قد تصل إلى فرض عقوبات على مسؤولي الشركة في حالة الإهمال الجسيم أو ارتكاب انتهاكات بيئية متعمدة. ويعتمد هذا البحث المنهج الوصفي التحليلي من خلال وصف النصوص القانونية ذات العلاقة وتحليلها للتوصل إلى تحديد المسؤولية القانونية للشركات عن الأضرار البيئية، كما يتم استخدام المنهج المقارن من خلال المقارنة مع الاتفاقيات الدولية. وهذا يُشجع الشركات على تبني تقنيات إنتاج مستدامة وصديقة للبيئة، مما يساعد في تحقيق التنمية المستدامة وحماية حقوق الأجيال القادمة. وبذلك، تسهم المسؤولية القانونية في دفع عجلة التطوير الصناعي مع الحفاظ على بيئة نظيفة وصحية. كلمات مفتاحية: المسؤولية القانونية.، الشركات.، الأضرار البيئية.، التغييرات المناخية. Abstract: This research seeks to determine the legal liability of industrial companies for environmental damages with the aim of balancing the development of industries and preserving the environment and its safety. Laws require companies to take preventive measures that limit environmental pollution and protect natural resources. The research addresses these types of liability, including civil liability imposed on companies to compensate individuals and communities for damages resulting from their activities, and criminal liability that may extend to imposing penalties on company officials in the event of gross negligence or committing deliberate environmental violations. This research adopts the descriptive analytical approach by describing and analyzing the relevant legal texts to determine the legal liability of companies for environmental damages. The comparative approach is also used by comparing with international agreements. This encourages companies to adopt sustainable and environmentally friendly production technologies, which helps achieve sustainable development and protect the rights of future generations. Thus, legal liability contributes to driving industrial development while maintaining a clean and healthy environment. Keywords: Legal liability; companies; environmental damage; climate change.
