الملخص
Islamic jurisprudence is one of the most prominent disciplines of the Islamic sciences that contributed to the construction of Islamic civilization, not merely as a system of legal rulings, but as a comprehensive epistemological framework grounded in revelation, guided by reason, and responsive to reality. With the transformations of societies and changing life patterns, there emerges a pressing need to re-examine fiqh from a humanistic perspective that revives its maqāṣid spirit, activates its ethical values, and affirms its civilizational role, ensuring balance between constants and variables while safeguarding human dignity and rights. This study addresses a central problematic: how can Islamic jurisprudence regain its humanizing function and realize mutual recognition in the context of contemporary transformations, without losing its textual authority or methodological integrity? Sub-questions focus on the epistemological foundations of fiqh, the place of the human being in legal reasoning, the interaction of text, reason, and context, and the role of ethics and maqāṣid in shaping legal judgments. The research aims to highlight the contours of humanizing Islamic jurisprudence through conceptual analysis, structural deconstruction, and practical applications, with emphasis on methodological tools such as maqāṣid and legal maxims, and the role of civilizational acquaintance in its philosophy. Ultimately, it seeks to present a normative vision that restores fiqh as a worldly science linked to reality while remaining faithful to its transcendental aims.
