Legal scholars have traditionally divided the methods of acquiring territory into original and transferable methods, depending on whether the territory in question is subject to the sovereignty of a state or is common property (Res nullius). Cession, conquest, and prescription (long-term possession) are transferable methods of acquisition, while seizure and annexation are original methods. Given the conceptual overlap between the term "annexation of territory," which results from military occupation (an invasion combined with placing the conquered territory under the effective control of the invading forces), this paper attempts to trace the evolution of the concept of territorial annexation between legitimacy and prohibition within the framework of international law. This is particularly relevant as the principle of the prohibition of territorial annexation, enshrined in contemporary international law, has resurfaced in the arena of international relations, making the topic of significant importance for academic research. The entry of forces into the territory, or part of it, by the forces of a belligerent state, constitutes an invasion. If the forces that entered the territory manage to actually seize it by establishing bodies to administer the conquered territory, this constitutes a military occupation, followed by a declaration of annexation.
