الأمن الصحي في القانون الدولي: التحول من المقاربة الوقائية إلى الحوكمة الصحية Health Security In International Law : The Transition From The Preventive Approach To Health Governance

الملخص
جاءت هذه الدراسة لمعالجة الإطار القانوني للأمن الصحي في ضوء أحكام القانون الدولي، من خلال تحليل الآليات والاتفاقيات التي أرستها المنظومة الأممية، وعلى رأسها اللوائح الصحية الدولية، باعتبارها المرجع القانوني الرئيس لتنظيم الاستجابة العالمية للأزمات الصحية. وتبيّن من خلال البحث أن تحقيق الأمن الصحي يمر عبر ثلاث مراحل أساسية هي: المقاربة الوقائية، مرورا بالمقاربة التشاركية الشاملة، حتى مرحلة الحوكمة الصحية العالمية، التي تكرّس التعاون الدولي. كما كشفت الدراسة عن وجود تحديات قانونية ومؤسسية تعيق الفعالية العملية لهذه الآليات، تتعلق بضعف الالتزام الدولي وتفاوت القدرات الوطنية. وانتهت الدراسة إلى ضرورة تعزيز الإلزام القانوني للاتفاقيات الصحية الدولية، وتطوير حوكمة صحية عالمية أكثر تنسيقًا وعدالة لضمان تحقيق الأمن الصحي العالمي المستدام. This study addresses the legal framework of health security in light of international law provisions, by analyzing the mechanisms and agreements established within the United Nations system, foremost among them the International Health Regulations (IHR), as the principal legal reference for organizing the global response to health crises. The research demonstrates that achieving health security progresses through three fundamental stages: the preventive approach, the comprehensive participatory approach, and finally, the stage of global health governance, which consolidates international cooperation. The study also reveals the existence of legal and institutional challenges hindering the practical effectiveness of these mechanisms, particularly the weak international commitment and disparities national capacities. It concludes by emphasizing the need to strengthen the legal enforceability of international health agreements and to develop a more coordinated and equitable global health governance system to ensure sustainable global health security.
