نحو نظام عام علمي لحرية البحث العلمي

الملخص
إن من بين أهم خصائص القانون الإداري اعتباره غير مقننا ومتطورا باستمرار لا يتوقف عن الحركة. وذلك لارتباطه الشديد والأساسي بالإدارة العمومية التي تتحسس باستمرار حاجات المواطن من جهة، وتحفظ نظامه العام من جهة ثانية، وذلك بممارسة اختصاصاتها في تقديم الخدمات العمومية وفق نشاط المرفق العمومي، وتنظيم وتقييد حقوقه وحرياته وفق نشاط الضبط الإداري. وإذا كانت حرية البحث العلمي تمثل وبلا شك أحد الحريات التي تحظى باهتمام تشريعي متواصل، من خلال دسترها وضمها في الكتلة القانونية ما دون الدستورية، فانه يتبادر طرح سؤال أساسي في هذا السياق: هل يوجد ما يسمى بنظام عام علمي؟ هل يمثل مفهوما مقبولا في نظرية الضبط الإداري؟ وما مبرره إن كان مبررا؟ خاصة في ظل انسحاب مدلول النظام العام اليوم كغاية للضبط الإداري، من المفهوم التقليدي إلى مفاهيم متحولة ومتطورة تواكب مختلف القيم المجتمعية. One of the most important characteristics of administrative law is that it is not codified and constantly evolving and does not stop moving. This is due to its strong and fundamental association with the public administration, which is constantly sensing the needs of the citizen on the one hand, and preserving his general system on the other hand, by exercising its competencies in providing public services according to the public facility activity, and organizing and restricting his rights and freedoms according to the administrative control activity. And if the freedom of scientific research is undoubtedly one of the freedoms that receive continuous legislative attention, through its dust and annexing it in the legal bloc without constitutionality, then it comes to a basic question in this context: Is there a so -called general scientific system? s it an acceptable concept in administrative control theory? What is justified if it is justified? Especially in light of the withdrawal of the public system today as a goal of administrative control, from the traditional concept to transformed and developed concepts that keep pace with various societal values.
