Abstract: This study examines the ICC Prosecutor's independence in initiating investigations, analysing the tension between the Rome Statute's formal powers and practical constraints. Using analytical and descriptive methods, the research explores Article 42's structural safeguards and Article 15's proprio motu powers. While the Statute grants unprecedented formal independence compared to ad hoc tribunals, this autonomy is significantly curtailed in practice. The primary constraints are the UN Security Council's indefinite deferral power under Article 16, strict complementarity application, and dependence on state cooperation for enforcement. The study reveals a critical gap between the "judicial independence" envisioned and the "political dependence" dictated by international realities..
