الملخص
يروم هذا المقال تقديم تحقيق علمي لبعض المسائل الخلافية بين علماء الحنفية والمالكية، ولا سيما المسائل التي يُجيزها الحنفية ويحرمها المالكية، وقد اعتمد البحث على القواعد المعتمدة في تحقيق المخطوطات، وجاء في مبحثين: خصص الأول للتعريف بالشيخ طاهر الجزائري، وبيان. وأما المبحث الثاني، فقد تناول التعريفابلمخطوط، مع إخراج نصه إخراجا علميا، بما يسهم في خدمة الدراسات الفقهية المقارنة. وقد خلص البحث إلى جملة من النتائج، من أبرزها التعريف بالعالم الشيخ طاهر الجزائري، وتحقيق نص "ذكر بعض المسائل التي تحل عند الحنفية وتحرم عندنا المالكية"، مع التأكيد على ضرورة العناية بالتراث الفقهي المغمور، وبخاصة المخطوطات التي ما تزال حبيسة الرفوف، لما لها من أهمية علمية ومنهجية في إغناء البحث الفقهي المعاصر. This article aims to provide a critical edition of several controversial legal issues (masāʾil) between the Hanafi and Maliki schools of jurisprudence, specifically those deemed permissible by the Hanafi jurists and prohibited by the Malikis. The research adheres to the rigorous methodological standards of manuscript editing and is structured into two main sections. The first section is dedicated to the biography of the author, Sheikh Tahir al-Jaza’iri, highlighting his scholarly status and his contributions to jurisprudential discourse. The second section focuses on the critical edition of the manuscript itself, presenting a reliable and verified text accompanied by an assessment of its scholarly value. This effort aims to serve the field of comparative jurisprudence and facilitate its accessibility for researchers and scholars. The study concludes with several key findings, most notably the introduction of the scholar Sheikh Tahir al-Jaza’iri and the realization of the text "Issues between Hanafi and Maliki Scholars." Furthermore, it emphasizes the necessity of attending to neglected jurisprudential heritage, particularly manuscripts that remain unpublished, due to their scientific and methodological significance in enriching contemporary legal research.
