الملخص
هذا بحث، بعنوان (خدمة اشتر الآن وادفع لاحقًا دراسة فقهية مقارنة) بحثت فيه مفهوم هذه الخدمة، وبيان التخريج الفقهي لها، والإشكالات الواردة عليها، وضوابط الشرعية لجوازها. وقد اعتمدت في البحث المنهج الاستقرائي، والوصفي، والتحليلي، فقمت بتصوير المسألة المراد بحثها، وبيانها في ضوء واقع التعامل بها، ثمَّ تخريجها على ما يناسبها إن كان لها أصل ترجع إليه أو نظير فقهي يمكن أن تلحق به. وقد تكون البحث من أربعة مباحث: الأول: مفهوم خدمة اشتر الآن وادفع لاحقًا، المبحث الثاني: التخريج الفقهي لخدمة اشتر الآن وادفع لاحقًا، المبحث الثالث: الحكم الشرعي لخدمة اشتر الآن وادفع لاحقًا، المبحث الرابع: الضوابط الشرعية لخدمة اشتر الآن وادفع لاحقًا. وقد خَلُصَتِ الدراسة إلى أنَّ الحكم الأقرب للصواب لخدمة اشتر الآن وادفع لاحقًا الجواز بضوابط شرعية مذكورة في البحث. Abstract This study, entitled “The Buy Now, Pay Later Service: A Comparative Jurisprudential Study,” examines the concept of the BNPL service, outlines its jurisprudential classification, discusses the main objections raised against it, and identifies the Sharia-based conditions required for its permissibility. The research adopts the inductive, descriptive, and analytical methodologies. It presents a clear depiction of the issue under study and analyzes it in light of contemporary financial practice. It then proceeds to its jurisprudential assessment by relating it to established principles and analogous cases in Islamic jurisprudence, when applicable. The study consists of four main sections: 1. The concept of the Buy Now, Pay Later service. 2. The jurisprudential classification of the BNPL service. 3. The Sharia ruling concerning the BNPL service. 4. The Sharia guidelines and conditions for its permissibility. The study concludes that **the most accurate ruling concerning the Buy Now, Pay Later service is permissibility**, provided that the Sharia-based conditions mentioned in the research are observed.
