Uses Of The Legitimate Purposes In The Jurisprudence Of Messrs. Maliki - Examples And Models -

Abstract
The most important topics related is that many issues of jurisprudence are linked to the divine legislative purposes. Noticing that the branches of the Maliki doctrine are full of examples bounds to these honorable task; Therefore, in this paper, I clarify the relationship of the branches of Maliki jurisprudence to the purposes of Sharia. So, the aim of the research is to demonstrate the Maliki school's interest in the objectives of Islamic law, and I concluded in the results that their doctrine employed many of them in its jurisprudence The research was organized in two topics as follows: The first topic is devoted to mention this purposes attached to the acts of worship . As for the second topic is devoted to mention the purposes attached to the acts of transactions with some examples and models, finally I concluded some important results and recommendations. إن تعلق كثير من المسائل الفقهية بالمقاصد الشـرعية من المواضيع المهمة، وفروع مذهب الإمام مالك تزخر بإعمالها للمقاصد الشرعية والتمثيل بها؛ لذلك أردت في هذا البحث بيانَ علاقة الفروع الفقهية عند المالكية باستعمال مقاصد الشريعة وتوظيفها لها في مؤلفاتهم؛ فحرَصت على إبراز كيفية تحقيق المقاصـد الشرعية ورعاية المصالح المعتبرة في فروع المذهب المالكي، وهَدَفُ البحث إظهار عناية المالكية بالمقاصد، وقد توصلت في النتائج إلى أن مذهبهم وظف كثيرا منها في فروعه الفقهية، وجاءت خطة البحث في مبحثين كما يلي: خصصت المبحث الأول لبيان نماذج من استعمالات مقاصد الشريعة المتعلقة بباب العبادات عند المالكية، وتناولت في المبحث الثاني تعلق مقاصد الشريعة بباب المعاملات، وجعلت نماذجَ وأمثلةً لبعض ما يتعلق منها بمقاصد الشرع، وجعلت في الأخير خاتمة، وأهم النتائج التوصيات.
