Provisions Of Electronic Endowment: A Foundational Jurisprudential And Legal Study

Abstract
Abstract: With technology expansion, waqf could be integrated into electronic systems. And with transparency, access to and interaction with donors became easier. But the primary issue is centered on how waqf rulings should be studied from a jurisprudential (fiqh) and legal perspective. Jurisprudential studies have shown that electronic waqf does not deviate from the general framework of traditional waqf, but differs only in the nature of the endowment, which has become a digital asset. This is legitimate according to the general evidence of traditional waqf. Furthermore, it achieves the objectives of Islamic Sharia in preserving endowed funds through documentation via these platforms, which verify the identity of the donor. From a legal perspective, legislation still lacks texts regulating its provisions in a manner consistent with the requirements of modern technology.
