Abstract: Jurisdiction is one of the fundamental principles on which Algerian justice is based. It determines the competent authority to examine and adjudicate disputes, ensuring the proper application of the law, the realization of justice, and the protection of individuals' rights and freedoms. Jurisdiction is of great importance as it clarifies the nature of the dispute and designates the appropriate body to resolve it, whether administrative or ordinary courts. It also prevents contradictory rulings in the same case, reinforcing the rule of law, judicial neutrality, and the protection of litigants' rights and freedoms. The administrative judiciary has jurisdiction over disputes related to administrative decisions issued by authorities responsible for construction and urban planning, such as building and demolition permits. One of the key legal mechanisms used to challenge such decisions before an administrative court is the annulment lawsuit (recourse for annulment). This legal action seeks to curb abuses of power by administrative authorities in urban planning matters. Individuals or organizations may challenge administrative decisions they consider unlawful or tainted with legal defects. The main objective of this lawsuit is to uphold the principle of legality and ensure compliance with the legislative and regulatory framework governing construction and urban planning. On the other hand, the criminal judiciary handles violations of construction laws, such as building without a permit, non-compliance with urban regulations, or illegal occupation of land designated for construction—issues frequently observed in practice. Offenders are prosecuted in accordance with the relevant legal provisions. There is often an overlap between administrative and criminal jurisdictions in urban planning cases. In many instances, administrative decisions may be subject to appeal before the administrative court, while the same violation may lead to criminal prosecution. Urban planning is therefore a sensitive domain prone to disputes, primarily arising from violations of construction laws and regulations under the Urban Planning and Development Law. In response, the Algerian legislator has established both regulatory and punitive legal frameworks to delineate the competencies of administrative and criminal courts, ensuring the protection of the urban environment and achieving harmonized urban development.
