الجريمة الاقتصادية : مفهومها - أسبابها و أثارها

الملخص
تهدف هذه الدراسة ، بالاعتماد على المنهج الوصفي التحليلي ، إلى تحديد المفاهيم الأساسية لمفهوم الجريمة الاقتصادية باعتباره مدخلاً لإيجاد الحلول ، وذلك من خلال التطرق لأسبابها وآثارها ، ولا يقتصر الغرض على التعريف بالجريمة الاقتصادية ، بل محاولة الإلمام بجوانبها بحكم طابعها المتغير تبعاً للسياسات الاقتصادية للدول وتطور المفاهيم المتجددة في الاقتصاد الذي يتسم بالمرونة والتجدد . فالسلوكات المخالفة للقوانين المنظمة للسياسات الاقتصادية يجب ردعها لما تحدثه من ضرر مباشر أو غير مباشر بالاقتصاد الوطني ، وهو ما يمنحها خصوصية كونها جريمة منظمة متحركة ومرنة، كما أن خصوصيتها تجعل التجريم يتجاوز الفعل المادي ، إذ تقوم الجريمة سواء تحقق الضرر أو لم يتحقق ، ما يبرر قسوة العقوبة ، وتشمل الخصوصية أيضاً أركانها ، فالنتيجة عنصر غير ثابت ، والعلاقة السببية لا تثير إشكالاً ، بينما يعد الركن المعنوي ضعيفاً ويتحقق بمجرد مخالفة القانون ، وتقتضي دراسة مفهوم الجريمة الاقتصادية المرور بأسبابها التي تجاوزت الإطار المحلي إلى الدولي نتيجة التحولات والتغيرات الاقتصادية والدور المزدوج للدولة والمشكلات الاقتصادية والاجتماعية والانفتاح الدولي ، وما خلّفه ذلك من آثار على مخطط الاقتصاد الوطني والمشاريع الوطنية وتنمية المجتمع ، بالإضافة إلى تأثيرها على الأفراد ودفعهم لاتخاذ قرارات مضرة بهم شخصياً وعائليا . This study , based on the descriptive analytical approach , aims to define the basic concepts of the concept of economic crime as an entry point for finding solutions , by addressing its causes and effects , the purpose is not limited to defining economic crime , but rather to attempt to understand its aspects , given its changing nature depending on the economic policies of countries and the development of renewed concepts in an economy characterized by flexibility and renewal. Behaviors that violate the laws regulating economic policies must be deterred by the direct or indirect harm they cause to the national economy, which gives them the peculiarity of being a mobile and flexible organized crime. Its specificity also makes criminalization go beyond the physical act, as the crime occurs whether harm is achieved or not, which justifies the severity of the punishment , Specificity also includes its pillars , The outcome is an unstable element, the causal relationship does not raise a problem, while the moral pillar is weak and is achieved simply by violating the law, Studying the concept of economic crime requires examining its causes, which extend beyond the local to the international framework as a result of economic transformations and changes, the dual role of the state, economic and social problems, and international openness , This has had repercussions on the national economic plan, national projects, and societal development, in addition to its impact on individuals, pushing them to make decisions that are personally and familially harmful to them.
