In recent years, the regulation of marine genetic resources beyond national jurisdiction has become an urgent issue in international maritime law. Albeit their huge scientific potential and economic interest, these resources remain extremely susceptible to biopiracy and uneven use due to wide gaps in current legal regimes. In this article, international actions to counter these threats, based on mechanisms of fair benefit-sharing, biopiracy avoidance, and transfer of technologies, are scrutinized critically, while stressing the responsibility of the United Nations, its conventions, and other expert organizations. through analyzing both advances and limitations of these actions, based on the role of these organizations, achievements, and ongoing gaps, the article reaches the conclusion that, in the absence of an integrated and effective international legal framework, marine genetic resources will be open to exploitation by technologically advanced countries, thereby promoting international inequality and undermining the principles of sustainable development and the common heritage of mankind.
