الترخيص الإداري المسبق كآلية لتدخل الدولة

الملخص
تتغير و تتطور وظيفة الدولة باستمرار تماشيا مع ظروف و حاجات المجتمع فمن قيامها بالوظائف التقليدية الأساسية من أمن تشريع و عدالة ....الخ تطورت تدخلاتها لتشمل الجانب الثقافي ،الاجتماعي و الاقتصادي وحتى درجة وصورة تدخلها في هذه المجالات تغيرت كذلك حسب ظروف و معطيات كل مجتمع فمن التدخل المباشر و التسيير إلى الضبط و التنظيم، حيث تم فتح المجال أكثر أمام النشاطات و المبادرات الفردية الخاصة في العديد من النشاطات ولكن بقت الدولة كسلطة عامة تقوم بوظيفة التنظيم و الرقابة كتوفيق بين حرية ممارسة الأنشطة وحماية النظام و المصلحة العامة ،هذا التدخل يتخذ صورا ووسائل عديدة من بينها الترخيص الإداري المسبق الذي يعتبر من أهم صور القرار الإداري الذي تعتمده السلطة الإدارية محافظة على النظام بمعناه الواسع في المجتمع ، وقد اعتمده المشرع الجزائري في تنظيم و ضبط العديد من مجالات ممارسة الأفراد لنشاطاتهم و حرياتهم الخاصة . From carrying out the basic traditional functions of security, legislation, and justice, etc., its interventions have evolved to include the cultural, social, and economic aspects, and even the degree and form of its intervention in these areas has changed according to the circumstances and data of each society From direct intervention and management to control and organization, where the field was opened more to private individual activities and initiatives in many activities, but the state remained as a public authority that performs the function of organization and oversight as a balance between the freedom to practice activities and the protection of the system and the public interest ، This intervention takes many forms and means, including prior administrative authorization, which is considered one of the most important forms of administrative decisions adopted by the administrative authority to maintain order in its broad sense in society. ،The Algerian legislator has adopted it to regulate and control many areas in which individuals exercise their activities and private freedoms. Through this simple study.
