تعزيز الأمن السيبراني كعنصر أساسي للتحول الرقمي في القضاء الإداري

الملخص
ملخص: للأمن السيبراني دور كبير في إنجاح مسار التحول الرقمي في القضاء باعتباره ركيزة أساسية لضمان استمراره، حيث ظهرت الحاجة إلى حماية المعطيات القضائية من المخاطر السيبرانية التي تهدد سلامة الإجراءات، وثقة المتقاضين. كما أنه يساهم في تجويد الأحكام والقرارات القضائية، بحماية الأدلة الإلكترونية، والإجراءات والأحكام، واستمرارية عمل الأنظمة الرقمية. فالتحديات التي تواجه القضاء الرقمي هي ضمان أمن قواعد البيانات، والمنصات الإلكترونية، فقصور الأطر التشريعية والتنظيمية يعرقل مواكبة التطور التكنولوجي المتسارع. ولمعالجته يتطلب وضع مقاربة تجمع بين الآليات التقنية والتشريعية والتنظيمية لردع الاعتداءات السيبرانية، فالأمن السيبراني لم يعد مجرد عنصر تقني داعم للتحول الرقمي في القضاء الإداري، بل أصبح شرطا جوهريا لحماية الحقوق، وضمان فعالية العدالة. والجزائر تسعى إلى تحقيق أمن سيبراني لمنظومة القضاء من خلال تصميم بنية تحتية تقنية وتشريعية قوية وفعالة. الكلمات المفتاحية: الأمن السيبراني، التحول الرقمي، القضاء الإداري، التشريع. Abstract: Cybersecurity plays a pivotal role in ensuring the success of digital transformation within the judiciary, as it constitutes a fundamental pillar for its sustainability. The need has emerged to safeguard judicial data against cyber threats that jeopardize the integrity of procedures and the trust of litigants. Moreover, Cybersecurity contributes to enhancing the quality of judicial rulings and decisions by protecting electronic evidence, judicial procedures, and the continuity of digital systems. The challenges facing digital justice revolve mainly around securing databases and electronic platforms, as deficiencies in legislative and regulatory frameworks hinder the ability to keep pace with rapid technological advancements. Addressing these challenges requires an integrated approach that combines technical, legislative, and regulatory mechanisms to deter cyberattacks. Cybersecurity is no longer merely a supportive technical element of digital transformation in administrative justice; rather, it has become an essential condition for safeguarding rights and ensuring the effectiveness of justice. Algeria, in particular, seeks to achieve a secure judicial system by establishing a robust and efficient technical and legislative infrastructure.
