الملخص
تناول هذا البحث موضوعا محوريا في مجال الاجتهاد الفقهي المعاصر بعنوان: تحقيق المناط في القضايا الطبية المعاصرة في ضوء مقاصد الشريعة -دراسة تأصيلية تطبيقية- وهو موضوع مهم يجمع بين أصل تحقيق المناط وبين مجال من أكثر ميادين النوازل تعقيدا وحداثة وهو الطب المعاصر، في ظل الحاجة الملحة الى اجتهاد شرعي يراعي التطورات العلمية الحديثة، ويسترشد بالمقاصد الكلية للشريعة، وقد هدفت الدراسة إلى بيان حقيقة تحقيق المناط وأنواعه وضوابطه، والكشف عن علاقته المنهجية بالمقاصد الشرعية، ثم تطبيق ذلك على عدد من القضايا الطبية المعاصرة التي تتطلب فقها مركبا يجمع بين فقه النص والواقع والمقصد والمآل، وتوصل البحث إلى أن تحقيق المناط يمثل أداة اجتهادية حيوية لا غنى عنها في فقه النوازل المعاصرة، وأن مراعاة مقاصد الشريعة ضرورة منهجية فيه لضمان تنزيل الأحكام على الوقائع تنزيلا يحقق مراد الشارع ويحفظ كليات الدين ويستوعب متغيرات الواقع. This research addresses a pivotal theme in the field of contemporary jurisprudential reasoning (ijtihad): "Tahqiq al-Manat in Contemporary Medical Issues in Light of the Maqasid al-Shari'ah: A Foundational and Applied Study." This is a significant topic that combines the foundational principle of Tahqiq al-Manat (verification of the legal cause) with one of the most complex and modern fields of emerging issues (Nawazil), namely contemporary medicine. This study is conducted in the context of the urgent need for a form of Sharia-based reasoning that considers modern scientific advancements while being guided by the universal objectives of Islamic Law (Maqasid al-Shari'ah). The study aimed to elucidate the reality of Tahqiq al-Manat, its types, and its regulating principles, and to uncover its methodological relationship with the Maqasid al-Shari'ah. Subsequently, this framework applies to a few contemporary medical issues that require a composite jurisprudence, integrating the understanding of the text (fiqh al-nass), the context (al-waqi'), the objective (al-maqsid), and the outcome (al-ma'al). The research concluded that Tahqiq al-Manat represents a vital and indispensable tool of ijtihad in the jurisprudence of contemporary issues (fiqh al-nawazil). Furthermore, it is found that observing the Maqasid al-Shari'ah is a methodological necessity within this process to ensure that rulings are applied to real-world situations in a manner that achieves the Legislator's intent, preserves the universals of the faith, and accommodates the variables of reality
