الملخص

ملخص: سنحاول من خلال هذه الدراسة أن نبين للقارئ بأنّ هناك فرقا شاسعا بين مصطلحي الحكم المحلي ومصطلح الادارة المحلية، وذلك لأن الكثير من الباحثين في هذا الشأن كثيرا ما يخلطون بين المصطلحين، وبما أنّ مصطلح الحكم المحلي هو نظام متبع في الدول الفدرالية حيث تكون الوحدة المحلية هناك أشبه ما تكون على شكل دول مستقلة لها نظامها وقوانينها الخاصة وحتى دستورها الخاص، وهذا طبعا عكس نظام الادارة المحلية الذي يقوم على نوع من اللامركزية في مجالات محددة، بينما تبقى السلطات المركزية هي صاحبة القرار النهائي، لأن القوانين الموحدة والدستور الواحد يكفلان هذا الانسجام بين المركز والمحليات، ومن هنا ظهرت اشكالية في اتجاه بعض الدول الى تقليد النموذج الفدرالي الامريكي ولكن دون الاخذ بعين أخطار التطبيق الميداني مما أدى في عديد الحالات الى الفشل وقد يؤول الامر الى النزاع والانقسام. Abstract: Through this study, we will try to show the reader that there is a huge difference between the term of local governance and local administration, because many experts in this matter often confusing the two terms. Since the term local government is a system followed in federal countries where the local units there are more independent, it’s like a state and each state has own system, laws and even its own constitution, This is, of course, the opposite of the local administration system, which is based on a type of decentralization in specific areas, while the central authorities remain the final decision-maker. Because unified laws and a single constitution ensure this harmony between central and local authorities, and from this approach a new problem has emerged in the tendency of some countries to imitate the American federal model without taking into their account the dangers of implementation, which has led in different cases to failure and may be it lead to conflict and division.
