دور القضاء في ادارة النزاعات وضبط المعاملات المالية التجارية في اسواق مدينة الجزائر خلال العهد العثماني ( 1519-1830م)

الملخص
استكمالا لجهود الباحثين في مجال النظم الادارية والمؤسسات الفاعلة في الجزائر العثمانية , تأتي هذه الدراسة لدراسة جانب مهم في مدينة الجزائر خلال العهد العثماني من خلال تحليل مختلف الادوار والمهام المرتبطة بالأجهزة القضائية المتنوعة من مجلس الداي, المحكمتان ( المالكية ؛الحنفية ) والمجلس العلمي, والاجهزة الرقابية في الاسواق. وعلاقتها بإدارة المرافق الاقتصادية والتجارية , فقد عرفت هذه الاجهزة نظاما اداريا و قضائيا متعدد الابعاد, حيث تداخلت هذه التنظيمات في تسيير الحياة اليومية للفرد و المجتمع .ومن هذا المنطلق حاولنا رصد مختلف التعاملات المالية التجارية كالبيع والشراء, والملكية والمعاوضة ., ضبط الاسعار والمكاييل , المرافعات .. وعلاقة هذه الهيئات بتسييرها, و الوقوف على التفاعلات القائمة فيما بينها وكذا الاسس المعتمدة في عملية تنظيمها. Abstract: Complementing the efforts of researchers in the field of effective institutions and administrative systems in Ottoman Algeria , this study comes to study an important aspect in the city of Algiers during the Ottoman era by analyzing the various roles and tasks associated with the various judicial organs from the Sharia courts( Royal; Hanafi ) and the scientific council or the Council of DEI , and regulatory bodies in the markets. In relation to the management of economic and commercial facilities , these bodies have known a multidimensional administrative and judicial system, where these organizations have interfered in the conduct of the daily life of the individual and society .From this point of view, we have tried to monitor various commercial transactions such as buying and selling, ownership and netting . , Price control and pints, disputes.. And the relationship of these bodies to their management, and to identify the interactions existing among them, as well as the foundations adopted in the process of organizing them .
