Résumé : La relation entre la constitution et l’enfance relève principalement de la spécificité d’une période fort fragile dans la vie de l’enfant qui représente la base fondamentale de la société, ce qui donne à cette relation une dimension stratégique dont les dispositions sont reflétées dans le système des lois inférieures selon la hiérarchie légale, comme le droit concernant la protection de l’enfant, le droit civil, ou le droit pénal. Cela crée une grande responsabilité pour le juge dans le sens d’établir cette relation, afin de sauvegarder les droits constitutionnels de l’enfant, selon les termes fondés de la constitution algérienne. Abstract: The relationship between the constitution and childhood falls within the specificity of a very fragile stage in a child's life, which represents the basic foundation of society. It gives this relationship a strategic dimension, because its provisions are reflected in the laws of the lowest degree according to the legal hierarchy, such as child protection law, civil law and criminal law. This situation creates a great responsibility for judges within the framework of establishing this relationship with the aim of protecting the constitutional rights of the child. So, a relationship in this way has a special character, especially in terms of explaining protection tools which the constitution was keen to explain.
